 Angel Fire Resort Vacation Rentals-Terms & Conditions

Please read carefully. All terms, conditions, rules, policies and regulations are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

Rental Agreement and Renter Requirements: The person placing the reservation is considered to be the Guest. All other persons involved with the rental are considered to be the Guests invitees, and all discussion regarding reservation, cancelation, and damage policies will be discussed with the Guest, not the Guest’s invitees. The Guest understands that Angel Fire Resort Vacation Rentals (hereinafter “AFRVR”) rents to responsible adults over the age of 21 ONLY. Identification will be required upon check-in. All Guest shall comply with all laws, orders, ordinances and other public requirements in the use of the rental.

Arrivals & Departures: Check-in time is 4:00 pm on arrival date. This time may be delayed should unforeseen circumstances arise. Check-out time is 10:00 am on the departure date. Early Check-In and Late Check-Out options may be available for an additional fee (this is not an option during Peak Times). Please contact us within 24 hours of your arrival to make these arrangements. If Early Check-In and/or Late Check-Out are approved you will get an email confirmation from the reservation team. If you have not arranged for a late check out, you may be charged $100 for each hour beyond 10 am you are still on the property, at a minimum of one hour.

Reservations: All reservations are subject to Management and Property Owner approval. Online rates are subject to change without notice. Please keep in mind, we do offer a Cancelation Waiver that cost 10.8% of the gross rental fee, and allows you to cancel within 48 hours prior to the check-in date.

Payments/Security Deposit: A reservation can be made with a 50% down payment paid by a valid credit card, check or money order if the reservation is made outside of 31 days from arrival. Deposit/Down Payment is due to reserve property. Balance Payment is due 30 days before Arrival and will be charged automatically to same credit card used, unless communicated otherwise. Within 30 Days of Arrival, Total Cost is due to reserve property. All Payments made within 30 days are NONREFUNDABLE unless Cancelation Waiver has been purchased.

Cash payment: If the Guest(s) has no Visa, MasterCard, American Express or Discover Card, a cash payment can be arranged which will include an additional $500 refundable security deposit. This security deposit will be returned within one week of the departure date, provided there is no breakage or damage to the premises and/or contents, there are no outstanding long-distance phone or pay-per-view charges, no additional cleaning costs, and all other rules of this agreement are adhered to. A $35.00 service charge will be incurred for any returned checks. 

If paying by check or money order, please send your check or money order with a signed copy of this agreement, 10 days prior to final payment deadline to allow sufficient time for check to clear.

Credit Card Authorization: A valid credit card to be kept on file is required upon Reservation. Guest hereby grants consent to charge Credit Card on file for any damages, missing items, excessive cleaning, fines, and, if necessary, cost incurred to remove Guest from property.

Cancellations & Refunds: If Reservations are canceled outside of 60 days of arrival, guest is issued a full refund less the cost of the waivers and credit card fees. If Reservations are canceled from 59 days to 31 days of arrival, Guest is refunded 50% less cost of waivers and credit card fees and Guest is released from financial liability on remaining balance owed. Cancelations with less than 30-day notice will result in 100% loss of all payment less any security deposit. This loss can be avoided if the Cancelation Waiver was purchased and the reason for cancelation is covered under the travel insurance policy. All reservation changes must be acknowledged in writing. AFRVR does not issue refunds due to acts of nature such as weather, road conditions, snow conditions, power outages or forest fires.

Vacation Rental Insurance: Insure Stays Vacation Rental Insurance is available through AFRVR and covers cancellation or interruption of your stay, travel delay, baggage delay, rental car damage, and emergency/medical/dental expenses. Please read your documentation carefully as certain limitations, restrictions, and exclusions apply. The plan is optional, but we strongly recommend it. In case of unforeseen events, this insurance helps protect your vacation investment. IF YOU CHOOSE NOT TO PURCHASE THIS COVERAGE, NO REFUNDS WILL BE GIVEN WITHIN THE 30-DAY PERIOD. Reschedules: Angel Fire Resort Vacation Rentals does allow for a one time reschedule prior to 30 days from date of arrival without a fee.

Damage Policy: A $49.00 damage protection policy charge is required for every reservation. The damage protection policy covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check out. The policy will pay a maximum benefit of $1500. Any damages that exceed $1500 will be charged to the credit card on file. If you damage the real or personal property assigned to your rental accommodation during the trip, the Insurer will reimburse the lesser or the cost of repairs or replacement of the property, up to $1500. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy https://angelfireresort.rentalguardian.com/ . By submitting payment for this plan, you authorize and request RG Travel Protection and Insurance Services to pay directly Angel Fire Resort Vacation Rentals any amount payable under the terms and conditions of the Vacation Rental Damage plan. Please contact Angel Fire Resort Vacation Rentals directly if you do not wish to participate in this plan or assignment and instead wish to pay the refundable $1000 security deposit.                                 

If a security deposit has been made, no portion may be applied to additional rental time or fees or other charges accrued by the Guest/Invitees. The entire deposit will be refunded if (1) no damage was done to the property other than reasonable wear and tear, (2) all keys are accounted for, (3) no items were missing, (4) all doors and windows were closed and secured upon departure, (5) all check out procedures were followed, (6) all Rental Agreement policies were followed, (7) no miscellaneous charges were incurred, e.g., unpaid rental fees, guests or pets, additional cleaning fees, or other charges. As a condition to the rental of all Vacation Properties, Angel Fire Resort Vacation Rentals reserves the right to charge the Guest’s credit card for any and all uncovered Guest/Invitee caused losses and damages sustained to the Vacation Property throughout the duration of their period of occupancy. In the event of any uncovered Guest/Invitee-caused loss or damage to the Vacation Property, including, but not limited to, extraordinary cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, AFRVR is hereby granted the right to charge the Guest’s credit card. An itemized statement outlining all associated costs will be sent via regular or electronic mail to the address submitted by the Guest at such time as the reservation was booked. By written or electronic endorsement of this Agreement, the Guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.                                                                                                            

Damage Waiver and Capacity Restrictions: Our properties are inspected before and after each reservation. Guests agree to pay for any flagrant damage to the units, excessive cleaning required at check-out, trash removal, missing items or damage to the units; contents, or any other accidental damage to anything within the rental unit during the rental period. Your reservation was charged $49.00 for a Damage Waiver to cover up to $1,500 in damage or we collected a deposit if any damages are above this then the Renter authorizes any said damage or missing items charged to their credit card identified above. The sleeping capacity for this property is limited to the number of beds provided, so twin beds sleep 1 guest; double, queen and king beds sleep 2 guests each. Extra guests beyond the maximum sleeping capacity are not allowed without the expressed written permission in advance. Each additional guest exceeding the maximum sleeping capacity for this property will incur a charge of 10% of the nightly rental rate, per guest, and will be charged to the credit card provided above.

Occupancy: Approved Guests are persons who will occupy the Premises. No unlawful activity or any other activity that constitutes a nuisance is permitted on Premises. Approved Guests take full responsibility for all lost or broken items, and any damages to the Property of any kind. No guests in excess of the maximum occupancy specified in the rental agreement shall occupy the property. Breach of this will result in immediate termination of the rental agreement with a forfeiture of the entire rental amounts and/or security deposit.

Approved Guests/Conduct of Guests/Property Use: The Premises are for the sole use as a personal vacation residence by Approved Guests. Reserving Guest is responsible for any guests that use the property during the term of this agreement. Guest may not exceed Max Occupancy for Property at any time. If the Premises are used, in any way, by more than max allowed guests, 9i) Guest and all others may be required to immediately leave the Premises or be removed from the Premises; (ii) Guest is in breach of this Agreement; and (iii) Guest forfeits its right to return of any monies collected. Guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the unit at any time may result in extra charges, and loss of any security deposit, in addition to any and all damage, disturbance, and cleaning charges. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis – please contact Angel Fire Resort Vacation Rentals for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the cabin can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.

Upon Arrival: Upon Arrival to unit guest shall examine the Premises, all furniture, furnishings, appliances, fixtures and landscaping, if any and shall immediately report, in writing, if any are not in operating condition or are in disrepair. Reporting repairs does not give Guest the right to cancel this Agreement or receive a refund of any payments made.

Unavailability: For any reason beyond the control of Management, the Premises become unavailable, Management may substitute a comparable unit or cancel this Agreement and refund in full all payments made by Guest.

Power/Weather Related Cancelation: We cannot be held responsible for circumstances beyond our control. This includes excessive noise from construction or public/private events, wildfire/smoke, weather related interruptions, road closures, lack of snow, frozen pipes, interruption of services and utilities or unexpected appliance breakdown. AFRVR does NOT issue refunds due to acts of nature such as: weather, road conditions, snow conditions, power outages or forest fires, but CSA Travel Protection Insurance does provide some protection against these instances.

Rules, Regulations & other: NO COMMERCIAL USE. Guest agrees to comply with any and all rules and regulations that are at any time posted on the Premises or delivered to Guest. Guest shall not, and shall ensure that Guest and Guest Invitees shall not: (i) disturb, annoy, endanger, or interfere with other Guests of the building in which Premises is located or its neighbors; (ii) use the Premises for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband; (iii) violate any law or ordinance; or (iv) commit waste or nuisance on or about the Premises. No illegal substances are allowed in the rental, and minors should not be in possession of alcohol. Violations will result in eviction from the property and no refunds will be issued. Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Please make sure you are comfortable with our Terms as they are strictly enforced.

Security Cameras in Use: Some of Angel Fire Resort Vacation Rentals have installed security cameras on the exterior of their homes. The goal, of these cameras, is to monitor outside activity and deter criminal trespassing. Interior camera use is not allowed and strictly forbidden. Security camera in use signs will be located on the home. If you are unsure if the property you booked has exterior cameras, please call us.

Strict Noise Ordinance: We have a strict noise ordinance that must be followed. No loud noises, music, load vehicles are allowed between the hours of 10:00 pm and 7:00 am. Please note if these rules are not followed you can be fined and asked to vacate the property.

No Parties: All of our rentals are in residential areas and may NOT be used for parties or large gatherings. Any disruptive events could result in the eviction and forfeiture of entire rental amount and security deposit.

No Smoking: Smoking is NOT permitted in any Angel Fire Resort Vacation Rentals. Smoking is allowed outside 30’ from building as long as butts and ashes are not left behind. Discard the butts and ashes appropriately. Do not throw butts on the ground (including the fire ring) nor bring them into the unit. If there is any tobacco smell in the unit after your departure, there will be a minimum $250 charge. Oil lamps, incense and candles are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for the additional cleaning required. If smoking does occur in the unit, (i)Guest is responsible for all damage caused by the smoking including, but not limited to, stains, burns, odors and removal of debris; (ii) Guests may be required to immediately leave the Premises, or be removed from the Premises; (iii) Guest is in breach of this Agreement.

Cleaning/Cleaning Fee/Cleaning Requirements: Premises will be delivered to Guest in a professionally cleaned condition. Should Guest’s use and activity require more than regular cleaning services, Guest will be charged for associated costs. A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels. Guest(s) are required to follow all check out procedures detailed in this agreement and our Property Binder and leave the property in the same general and good habitable condition it was in when the Guest (s) arrived. Undue and/or unreasonable cleaning of the unit shall be charged to the Guest’s/Cardholder’s credit card as an Additional Cleaning Charge at a rate of up to $100/hr., with a one hour minimum. This also applies to the property exterior, grounds, BBQs and hot tubs (if so equipped). A starter supply of expendable supplies such as paper goods and soap are provided; please bring additional if you feel this will not be adequate for your stay. Basic cleaning supplies are stocked to do your own cleaning during your stay. Housekeeping is not provided during your stay.

Pre-Departure cleaning requirements:

  1. Place soiled towels in the bathtub.
  2. All dirty dishes, cookware and eating utensils should be washed, rinsed, dried and put away in the property location.
  3. Floors should be in generally good condition and ready to be vacuumed by our housekeepers.
  4. All household trash, garbage, recycling and/or other discarded items should be property bagged and deposited in the property refuse location outlined in the Property Binder. Homes and Condos are located in mountain settings where wildlife abounds-therefore, under NO circumstances should household refuse be deposited and/or otherwise left unsecured outside or additional charges may apply.
  5. Refrigerator and microwave should be left clean and free of food.
  6. All appliances (stove, oven, BBQ, etc.) should be left in a clean condition and free of spills and grease.
  7. Please wipe down counters and other surfaces.
  8. All litter must be picked up from the premises.
  9. GLITTER AND CONFETTI ARE NOT ALLOWED AT ANY PROPERTY, INSIDE OR OUTSIDE.

Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $100/hr., with a one-hour minimum:

Pets: Pets are ONLY allowed in designated Pet Friendly Units (additional fee applies) except for pets allowed via ADA. If an unauthorized pet is discovered in a non-pet friendly unit, a minimum fee of $250.00 will be charged to the credit card on file on the reservation. If you are given permission to bring a pet the following rules must be followed:

  1. $75 per pet occupancy fee and a $50 per pet cleaning fee.
  2. No pets on any furniture or bedding.
  3. Please do your best to remove all pet hair to avoid additional cleaning time/charges.
  4. All waste must be disposed of according to our Property Binder, we do not have trash disposal service so we ask all our guests and owners to bring their trash to the Village’s facility in town. More information is in the Property Binder.
  5. No pets in the hot tub or bath tub.
  6. Pets should not be left unattended in cabin unless crated.
  7. Damage up to $1500 caused by authorized pets is COVERED if you opted in for the Vacation Rental Damage plan. Otherwise, guest assumes full responsibility for any damage caused by pet to be charged to credit card on file.
  8. Any cleaning that must be done will be charged to the renter at rate of $100 an hour.

Spa/Hot Tub Use & Rules: If so equipped and Guest has purchased the right to use, spa heating is included. Guest agrees not to manipulate heater in any way to exceed the manufacturer’s recommendation or 104 degrees. Guest understands that the area surrounding spa may not be fenced or secure. Guest understands and agrees to be responsible and liable for any damages that occur to the spa and its support equipment through guest misuse and/or negligence. Use of the hot tub/spa is strictly at your own risk and liability. Our hot tub company sanitizes and replenishes chemicals in all hot tubs prior to your arrival. If additional maintenance is required during your stay, or the next guests are unable to use the spa due to conditions resulting from your failure to observe the following rules, there will be a $100 charge (and costs of supplies if necessary) for each hour of required maintenance. Instructions for the tub controls are posted at the hot tub or we will be happy to help you. All fees associated with Hot Tub rental/use will be refundable if you are unable to use the hot tub due to malfunction not caused by Guest (s).

  1. ALWAYS SHOWER OR BATHE BEFORE AND AFTER USING THE HOT TUB! Body oil, makeup, hair products, etc. clog filters.
  2. If home is equipped with exterior Security Cameras, please keep in mind the cameras may be positioned to include hot tub.
  3. Swimsuits must be worn in spa.
  4. An adult must always accompany children.
  5. Observe the safety precautions posted at the tub and have all guests do likewise.
  6. Pregnant women, small children, people with health problems and people using alcohol, narcotics and other drugs that cause drowsiness should not use spa without first consulting a doctor.
  7. Do not sit, stand or lie on the tub cover; a $300 charge will be made if the cover is broken.
  8. Unhook the safety strap before removing the cover.
  9. Replace cover and thermal blanket (where provided) when you are not in the tub and secure the safety strap to conserve heat, for safety, and to keep debris out of the water.
  10. If temperature has been adjusted during use, MAKE SURE to return the temp to the original setting when done.* Failure to reset may cause the hot tub to over-temp & stop working, possibly resulting in additional charges.
  11. Use non-breakable drink containers in the tub area.
  12. DO NOT ADD ANYTHING TO THE HOT TUB WATER such as bubble bath & oils, even if they say they are compatible.
  13. If the water level is low (below the filter intake) add more water or call, as low water can destroy the pump, resulting in additional charges.
  14. If the water looks cloudy or dirty, please call.* If it is found that the service is necessary due to Guest abuse, the Guest will be responsible for the charges.

*Hot tubs may be drained and refilled before your arrival; therefore, it may not be warm until later that evening. Also, due to the high mineral content in the mountain water at some of our cabins, the hot tub may initially appear cloudy until the minerals settle. If the conditions persist, please call.)

Woodstoves/Fireplace: If wood is provided at your property, it is provided for indoor use only! If it is found that any wood is used or cut from a property, a minimum of $100 will be charged! When there is a fire, the door/screen must be closed (except to add wood). The fireplace cannot be used when there is a stagnant air burn ban or Village of Angel Fire no burn ban. Please check website for outdoor burn bans. Do not put anything except wood or wood products in the woodstove/fireplace. Do not put any flammable material on or near any heat source, such as the electric baseboard or wood stove. DO NOT LEAVE UNIT WITH A FIRE IN THE WOODSTOVE OR FIREPLACE!

Linens & Towels: Bath towels, sheets, pillows and blankets are provided. We do not provide any linens or towels for outdoor use. DO NOT take the cabin’s linens or towels outside. Bring items with you that you may need to outdoor use, hot tub/spa use or smoking outside. Please allows us to wash the unit’s linens unless you need clean linens during your stay. Extra sheets and towels are provided if you are staying a week or longer (otherwise one set per guest are provided where laundry facilities are available).

Lost Items or Left Items: Please check carefully for belongings before you leave. Left items can be mailed to you if requested and you will be charged shipping costs plus a $35 service fee. Pick up may also be arranged at our Angel Fire office. Angel Fire Resort Vacation Rentals is not responsible for lost or stolen items.  Management assumes no responsibility for lost, stolen or abandoned items. Reasonable effort will be made to contact the Guest for return. Management shall not be held liable for condition of said items. Any items not claimed for longer than 30 days, may be donated or sold.

Emergencies, Maintenance & Reporting: In the event of a problem getting in the unit or if there are problems with condition or functionality of the unit, please immediately contact the AFRVR office (leave a voice message if there is no answer) at 575.377.6767. If it is after office hours, we will make every effort to return your call as soon as possible. If we do not promptly return your call and it is an urgent situation, you may call our after-hours emergency phone 575.447.2131.  Otherwise, you will be contacted during normal business hours.

Guest shall properly use, operate and safeguard the Premises including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Guest shall immediately notify Management of any problem, malfunction or damage. Guest shall pay for all repairs or replacements caused by Guest, excluding ordinary wear and tear. Guest shall pay for all damage to the Premises as a result of failure to report a problem, malfunction or damage in a timely manner.

Parking and Winter Conditions: During winter, we will attempt to have the driveway and walkways clear of snow before your arrival. But during severe storms, please be patient with the drivers as they are doing all they can to keep up with the accumulation. A shovel may be available at unit should you need it during your stay. Please be cautious when there are icy conditions. During winter months, it may be required to carry chains or have traction tires, a 4-wheel drive is recommended. Be sure you know the laws in regards to winter parking. Do not park in the street. Your car will be a ticket and/or be towed. Driving conditions may be hazardous as well. Be prepared.

Right of Entry: Management and Managements representatives and agents have the right to enter the Premises, at any time, (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, for maintenance or to supply necessary or agreed services: (ii) to verify that Guest has complied with the terms of this Agreement; or (iii) in case of emergency. Guest(s) agree that AFRVR reserves the right to enter the rental property any time to investigate disturbances, check occupancy and check for damage.

Security and Safety Risks: Always lock doors and windows when you leave the premises. When you rent the unit, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave. Guests are responsible for lost key replacement costs. Children are welcome, but there are conditions in and around the home that may pose hazardous to them, as well as to adults, such as the river, steep riverbank, open stairways, wildlife, icy surfaces and fireplaces. Children must be supervised at all times. Candles are not allowed due to fire hazard except citronella candles in buckets outside, or supplied emergency candles in case of power outages.

Property: Guest rents, for vacation purposes only, the furnished real property and improvements described.

Air Conditioning/Heating: Our rentals are not equipped with air conditioning. Guest agrees that heat shall not be set above 78, and that the fan setting shall be “Auto”. Doors and windows shall be closed when heat is in operation. There are no refunds for lack of, or malfunctioning HVAC units.

Plumbing: Do not put any feminine products in the toilet. Typically, toilets do not have a strong flush-limiting the amount of toilet paper used will help prevent a clog. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

Satellite TV & Internet: All properties are privately owned and have different subscription packages for cable and/or satellite and internet. AFRVR does not guarantee any programs, events or reception. Guest(s) are liable for ordering any Pay Per View – if Guest(s) does not use their own credit card for ordering, programming charges plus an additional $5.00 processing fee will be charged to the credit card we have on file. No refund shall be given for number of devices, outages, content, or lack of content or personal preferences with regard to cable/internet/satellite service. Services are provided as a convenience only, and are not integral to this agreement. No refund shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to service

System(s) Failures: In the event the rental unit sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, pool, hot tub or other system or structural systems, neither the property owner nor the Management shall be liable to Guest for damages, and no refunds will be given for such failures. However, Management will make an effort to promptly repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the property to inspect and make such repairs.

Personal Property and Injury: (i) Owner Insurance: Guest personal property, including vehicles, are not insured by Owner or, if applicable, HOA, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner/Management does not insure against personal injury to Guest, guests or licensees due to any reason other than the condition of the Premises. (ii) Guest Insurance: Management recommends that Guest carry or obtain insurance to protect Guest and licensees and their personal property from any loss or damage. (iii) Indemnity and Hold Harmless: Guest agrees to indemnify, defend and hold harmless Owner and Management from all claims, disputes, litigation, judgements, costs and attorney fees resulting from loss, damage or injury to Guest or licensees or their personal property.

Mediation: Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

Joint and Individual Obligations: If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.

Indemnification & Hold Harmless: While AFRVR and its Property Owners strive to maintain Vacation Properties in the finest condition, no guarantees or warranties (either expressed nor implied) are given regarding the suitability of for any particular purpose. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk. AFRVR and it’s Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No warranties (express nor implied) as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees (expressed nor implied) regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. AFRVR and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliance, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify AFRVR and its Property Owners from and against all claims, demands, loss, liability/responsibility of the kind and character, including cost of defense, arising out of/or in any way connected with the Guest(s) use of the property.

Release: In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my children’s or the guest’s participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.

In the event of a dispute regarding this agreement, the parties agree that New Mexico Law and exclusive jurisdiction shall apply and the proper venue shall be Eighth Judicial District Court, Colfax County, New Mexico.
